Dar firm demands damages from Barclays bank

TANAR Electronic Security Company Limited has filed a case against Barclays Bank and its official, Samuel Renju, demanding 50m/- being damages, loss of profit and business opportunities for being irresponsible and untrustworthy.

The firm filed the suit at the Kisutu Resident Magistrate’s Court in Dar es Salaam. Hearing of the suit starts today before Principal Resident Magistrate Euphemia Mingi.

It is alleged that on April 10, 2004, the company entered into agreement with the bank for installation of electronic security equipment on their premises and later placed an order for purchasing the equipment and accessories from a South African Company, Centurion System (PTY) Limited.

On April 14, 2004, the company, through its director, Mr Zilly Mruma, approached the bank in Arusha to effect cash transfer to South Africa for the said order and was attended by Mr Renju.The company paid 1.6m/-, equivalent to 9009 South African Rand and other 80,000/- as commission charges.

It is alleged that the company intended to open an account at the bank so as to transfer the money easily, but the bank assured the firm that transfer of money did not necessarily require one to open an account and that he would get quality services.

Due to that, the company released the said amount for the said purposes. However, after a couple of days, the company realized that the amount transferred to South Africa was less than what was paid to the bank.

Moreover, the amount was delivered very late contrary to the agreement. It is alleged further that the firm wrote a letter to the bank, demanding to know the reasons behind the deductions and delays. The bank allegedly replied, regretting for the incidence and promised to investigate and rectify the problem.

However, nothing was done and as a result of the delay and non transfer of the whole amount, the SA firm shipped incomplete order, causing the company to suffer damages, it further charged.
